Texas Guardianship

When a child reaches 18 or an adult becomes feeble of mind, the proper way to legally have another put in charge of their affairs is a Guardianship. Michael Wald handles all aspects of guardianships.

There are two types of guardianships. One for the body—where the person will live. One for the finances—who will be in charge of their money. For financial guardianships, an annual report or accounting is required to be filed with the court, making it an ongoing, somewhat expensive procedure. In any event, a guardianship should only be granted by the court when it is shown to be necessary. Usually a doctor’s statement is required. Usually a bond must be posted with the court by the person appointed to ensure that that person does not improperly deal with the affairs of the incapacitated person. A guardianship over financial affairs will take precedence over a power of attorney. Therefore, contests are common in guardianships when they are filed by a person other than the one who has power of attorney.
